Public Hearing Notice

NOTICE OF PUBLIC HEARING

Notice is hereby given that the City of DeFuniak Springs City Council will conduct a public hearing on Monday, August 12, 2019, at 6:00 PM CST (or as soon as the item may be heard), at the DeFuniak Springs Community Center, located at 361 North 10th Street, DeFuniak Springs, FL 32433.

The purpose of the hearing is to consider a variance request (File #2019-VAR-02) from the applicants, Ascencion Espinoza and Graciela Garcia, for property located at 227 West Orange Avenue. The property is legally described as Lots 1 and 2 of the Subdivision of Block 1866 DeFuniak. The parcel identification number of the property is 25-3N-19-19290-000-0010.

The applicants are requesting approval to construct a 14.9’ X 27.3’ (406+/- SF) addition onto the rear of their home; they want the addition to line up with their home which is 10-feet from the property line of South 17th Street (instead of the 25-feet required by the LDC). In order to build the addition, city council would have to approve a variance application to allow a 15-foot setback variance from the requirements found in Land Development Code (LDC), Section 18-44, "R-2" Multiple Family Residential District. This public hearing is to hear public comments about this request.

All interested parties are invited to attend the public hearing and shall have the right to submit oral and/or written comments for City Council’s consideration.

Any questions may be directed to the attention of the Planning Department during regular business hours by calling (850) 892-8571, Ext. 116 or in person at 35 US Highway 90 West, DeFuniak Springs, FL 32433.

In accordance with Section 286.26, Florida Statutes, “Accessibility of public meetings to the physically handicapped, whenever any board or commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision that has scheduled a meeting at which official acts are to be taken, receives at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting, directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.”

In accordance with Section 286.0105, Florida Statutes, “Notices of meetings and hearings must advise that a record is required to appeal, all persons are advised that, if a person decides to appeal any decision made by the board, agency, or commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.” Appeals of City Council decisions are heard by the Circuit Court of Walton County.

Notice was provided by publication in the DeFuniak Herald on July 10, 2019, and direct notice was provided to adjoining property owners within 1,000 feet of the subject property.
